These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "User"), and ReckTech Digital, doing business as BilletPro ("Company," "we," "us," or "our"), concerning your access to and use of the billetpro.io website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Platform").
By accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND YOU MUST DISCONTINUE USE IMMEDIATELY.
1. INTRODUCTION (RECKTECH DIGITAL DBA BILLETPRO)
BilletPro is a "doing business as" name of ReckTech Digital ("ReckTech Digital," "BilletPro," "Company," "we," "us," or "our"). These Terms govern your access to and use of the Platform and any related services, features, content, products, and applications we make available.
You represent that you have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization or other entity, you represent and warrant that you are authorized to bind that entity to these Terms, and "you" includes both you and that entity.
2. DESCRIPTION OF SERVICES
BilletPro is a sports technology platform designed to facilitate connections between athletic organizations, athletes, and host families (the "Billeting Services"). Our services may include, without limitation:
- AI-powered matching tools that generate suggested matches based on information provided by Users and compatibility signals.
- Availability and schedule management tools.
- Secure in-platform messaging and notifications.
- Program management tools for sports organizations (including placement workflow and administrative tooling).
- Background check facilitation and verification features for host families (as further described below).
We may modify, update, suspend, or discontinue any part of the Platform at any time. We do not guarantee that any specific feature will be available at all times.
3. USER ACCOUNTS AND RESPONSIBILITIES
To use certain features of the Platform, you must create an account and provide accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality and security of your login credentials.
- All activity that occurs under your account (including activity by anyone you allow to access your account).
- Promptly updating your account information if it changes.
- Using the Platform in compliance with applicable laws, these Terms, and any policies or guidelines we provide.
Minors
Athletes under the age of 18 must use the Platform with the consent and supervision of a parent or legal guardian. The parent or guardian is responsible for the minor's compliance with these Terms and for all activity conducted through the minor's account.
User Roles
Depending on how you use the Platform, you may be an athlete, a host family, a sports organization, a coach/manager, or another participant. Without limiting other obligations in these Terms:
- Sports Organizations/Managers: Are responsible for their own program operations, including participant eligibility, supervision, and compliance with league/team rules and safety protocols.
- Host Families: Are responsible for providing accurate information, maintaining a safe and supportive environment, and complying with any hosting standards or requirements applicable to them.
- Athletes: Are responsible for complying with applicable codes of conduct and any organization/team rules.
Matching Tools and No Guarantee
BilletPro may provide AI-driven matching tools to suggest potentially compatible placements. You understand and agree that:
- The Platform provides suggestions and workflow tools only; it does not guarantee the success, suitability, legality, or safety of any match, placement, or living arrangement.
- Final decisions regarding participation and placement rest solely with Users (including, as applicable, the athlete, host family, and/or sports organization).
- The Company is not a party to any agreements between Users (whether formed on-Platform or off-Platform) and is not responsible for enforcing any such agreements.
4. PAYMENTS AND FEES (VIA STRIPE)
Certain features of the Platform may require payment of fees (for example, subscriptions, program fees, verification fees, or background-check-related charges). You agree to pay all fees disclosed to you in connection with your use of paid features.
Stripe
Payment processing services are provided by Stripe and are subject to Stripe's terms and policies (including the Stripe Connected Account Agreement, where applicable). By making or receiving payments through the Platform, you authorize us and Stripe (as applicable) to process payments and share information necessary to complete transactions and help prevent fraud.
Billing Authorization
You agree to provide accurate billing and payment information and authorize us (and/or Stripe) to charge your selected payment method for applicable fees, taxes, and other charges you incur.
Fees; Taxes; Refunds
Unless otherwise stated in writing by us:
- Fees are non-refundable.
- You are responsible for any applicable taxes, and tax amounts may be added where required.
- We may change fees at any time, but we will not charge you retroactively for fees that were not disclosed before the charge was incurred.
5. BACKGROUND CHECKS AND VERIFICATION
The Platform may include tools that facilitate identity verification and/or background checks for host families and, in some cases, other Users. Background checks and verification may be conducted by third-party providers and may require your consent and the provision of personal information.
You understand and agree that:
- Background checks and verification are based on available data sources and may be incomplete, may contain errors, or may not identify all past conduct or risk factors.
- The Company does not make any representation or warranty regarding the accuracy, completeness, or timeliness of any background check or verification result.
- Verification or a "passed" status does not mean a User is endorsed, guaranteed, or safe.
- Users are responsible for conducting their own due diligence and exercising caution before entering into any hosting arrangement or other offline interaction.
6. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, RECKTECH DIGITAL DBA BILLETPRO, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER DAMAGES ARISING FROM OR RELATED TO (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE PLATFORM, (B) ANY USER CONDUCT OR OFFLINE INTERACTIONS, OR (C) ANY PLACEMENT, MATCH, OR HOUSING ARRANGEMENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
7. TERMINATION
We reserve the right, in our sole discretion and without notice or liability, to suspend or terminate your account and/or deny access to the Platform to any person for any reason, including without limitation for breach of these Terms.
Upon termination, your right to use the Platform will immediately cease. Sections that by their nature should survive termination (including, without limitation, limitation of liability, indemnification, and governing law) will survive.
8. GOVERNING LAW
These Terms and your use of the Platform are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
